The two Marion County Sheriff's Deputies who fatally shot a man in November have returned to normal duty after the incident was ruled appropriate by a grand jury.

According to reports, Dep. Mike Wheeler and Maj. Aaron Corwin used justified force in the Nov. 25 shooting of Byron Holveck, 40, outside of his home on Smeltzer Rd. At just after 10 p.m., The Officers responded to a call alleging that Holveck was threatening to kill his girlfriend with a hand gun.

The pair of Officers arrived and were confronted by Holveck who, according to reports, pointed a gun at them and ignored commands to stop. The Deputies then fired from 15-20 feet, hitting Holveck who was later taken to a Columbus hospital where he died.

Agents from the Ohio Bureau of Identification were called to investigate the shooting while Wheeler and Corwin were placed on paid leave. Investigators found that Holveck had expressed suicidal intentions in the time leading up to the incident.

According to Marion Co. Prosecutor Brent Yager's office, no criminal prosecution or further disciplinary action will take place and both officers have returned to work.
